1. Welcome to HobbyMela

Welcome to HobbyMela.

Hobbymela is a platform that celebrates creativity by bringing together artists, makers, hobbyists, learners, businesses and creative communities. Our Platform helps people discover artists, explore handmade creations, participate in creative workshops and experiences, engage with inspiring content, and build meaningful connections within the creative ecosystem.

These Platform Terms of Use ("Terms") govern your access to and use of the Hobbymela website, mobile applications (if introduced), and all related products, services, content and features (collectively, the "Platform").

By accessing, browsing, registering for, or using the Platform, you agree to comply with these Terms, our Privacy Policy, and any other policies incorporated by reference.

If you do not agree to these Terms, you should not access or use the Platform.

2. About HobbyMela

Hobbymela is designed to support the creative ecosystem by enabling discovery, learning, collaboration and engagement between artists and the wider community.

Depending on the services available at a given time, the Platform may allow Users to:

  • Discover Artists and creative professionals.
  • Browse Artist Profiles and portfolios.
  • Explore handmade products through the Artist Discovery Marketplace.
  • Connect with Artists regarding products, commissions or collaborations.
  • Discover and book creative workshops and experiences.
  • Participate in online or offline creative events.
  • Follow Artists and receive updates.
  • Explore corporate gifting and workshop opportunities.
  • Access content relating to arts, crafts and creativity.

Hobbymela may introduce new services, modify existing services or discontinue certain features from time to time.

3. HobbyMela's Role

Hobbymela is a platform that facilitates discovery, connection and engagement within the craft  community.

Unless expressly stated otherwise:

  • Hobbymela does not manufacture, own or sell products displayed by Artists.
  • Hobbymela does not act as an agent for Artist’s products.
  • Product purchases are entered into directly between the User and the Artist.
  • Hobbymela is not responsible for manufacturing, quality control, inventory management, packaging, shipping or fulfilment of products offered by Artists.
  • Hobbymela does not currently process payments for product purchases made through the Artist Discovery Marketplace unless a future feature expressly provides otherwise.

For workshops and creative experiences, Hobbymela may facilitate discovery, enquiries and bookings. Unless specifically stated otherwise, workshops are organized and conducted by independent Artists or organizers.

Nothing in these Terms creates an employment, partnership, agency or joint venture relationship between Hobbymela and any Artist or User.

4. Definitions

For the purposes of these Terms:

Account means a registered account created to access one or more features of the Platform.

Artist means any individual, studio, collective, organization or business that creates, teaches, exhibits or offers craft-creative products, workshops, experiences or services through the Platform.

Artist Discovery Marketplace means the section of the Platform where Artists showcase products and services to enable Users to discover and connect with them. Product transactions are complete between the User and the Artist unless Hobbymela expressly provides otherwise.

Community Features means forums, chats, discussions, comments, reviews, reactions, groups, messaging, follows or other social and collaborative features made available on the Platform.

Content includes text, images, videos, audio, artwork, designs, comments, reviews, workshop information, product listings, profile information and any other material available on or uploaded to the Platform.

Creative Experience means any workshop, class, event, demonstration, exhibition, retreat, online session or other creative activity listed on the Platform.

Corporate Client means any business, institution or organization using Hobbymela to discover Artists or creative services for workshops, gifting, commissions or collaborations.

Platform means the Hobbymela website, applications, software, content, services and all related features.

User means any individual or organization accessing or using the Platform, including Artists unless the context indicates otherwise.

User Content means any Content uploaded, submitted or published by a User or Artist on the Platform.

5. Eligibility

You may use the Platform only if:

  • you are legally capable of entering into a binding agreement under applicable law;
  • the information you provide is accurate, complete and up to date;
  • your use of the Platform complies with these Terms and all applicable laws.

If you are under the age of 18, you may access or use the Platform only with the involvement or consent of your parent or legal guardian where required by applicable law or by the relevant Artist or organizer.

If you are using the Platform on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms.

6. Your Account

Certain features of the Platform require you to create an Account.

When creating an Account, you agree to:

  • provide accurate and complete information;
  • keep your information updated;
  • maintain the confidentiality of your login credentials;
  • promptly notify HobbyMela of any unauthorized use of your Account or any security breach;
  • accept responsibility for all activities carried out through your Account.

You must not:

  • create an Account using false or misleading information;
  • impersonate another individual or organization;
  • create multiple Accounts for deceptive, fraudulent or abusive purposes;
  • transfer or sell your Account to another person without HobbyMela's prior written consent.

Hobbymela reserves the right to verify Account information where reasonably necessary to protect the integrity of the Platform.

7. User Responsibilities

When using the Platform, you agree to:

  • use the Platform only for lawful purposes;
  • treat other Users with courtesy and respect;
  • provide truthful and accurate information;
  • comply with applicable laws and regulations;
  • respect the intellectual property and privacy rights of others;
  • use the Platform in a manner consistent with its purpose of promoting creativity and collaboration.

You are responsible for all actions taken through your Account and for ensuring that your use of the Platform does not adversely affect other Users or the Platform itself.

8. Artist Accounts

Artists may create an Artist Profile to showcase their creative work, products, workshops, services and professional information.

By creating an Artist Profile, an Artist agrees to:

  • provide accurate, current and complete information;
  • ensure that portfolio images and product photographs are theirs & fairly represent the work being offered;
  • keep pricing, availability and contact information reasonably up to date;
  • comply with applicable laws relating to their business and creative practice;
  • honour commitments made to Users through the Platform.

HobbyMela may request additional information or documentation to verify an Artist's identity or business details where reasonably necessary.

Verification by HobbyMela does not constitute an endorsement, certification or guarantee of the Artist, their products or their services.

9. The Artist Discovery Marketplace

The Artist Discovery Marketplace enables Users to discover handmade products, creative services and commissioned work offered by independent Artists.

The Marketplace is intended to facilitate discovery and direct connections between Users and Artists.

Unless HobbyMela expressly introduces integrated commerce services in the future:

  • product purchases are concluded directly between the User and the Artist;
  • payments are made directly to the Artist;
  • shipping and delivery are arranged by the Artist;
  • returns, exchanges and warranties are managed by the Artist;
  • tax invoices or similar documents are issued by the Artist where applicable.

Artists are solely responsible for the accuracy of their listings, pricing, descriptions, availability and compliance with applicable laws.

HobbyMela reserves the right to remove or restrict listings that violate these Terms, applicable law or the Platform's policies.

10. Workshops & Creative Experiences

HobbyMela enables Artists and other approved organizers to list, promote and offer workshops, classes, demonstrations, events, exhibitions, retreats and other creative experiences through the Platform.

Creative Experiences may be conducted:

  • In person;
  • Online;
  • In a hybrid format; or
  • Through any other format introduced by Hobbymela.

Participation in a Creative Experience is subject to these Terms and any additional information or conditions provided by the Artist or organizer.

10.1 Workshop Information

Artists are responsible for ensuring that all information relating to their Creative Experiences is accurate, complete and up to date.

This includes, where applicable:

  • workshop title;
  • description;
  • venue or online platform;
  • date and time;
  • duration;
  • participant capacity;
  • fees;
  • skill level;
  • age restrictions;
  • materials provided;
  • materials participants must bring;
  • safety requirements; and
  • cancellation or rescheduling terms.

10.2 Bookings

Where available, HobbyMela may facilitate:

  • workshop discovery;
  • booking requests;
  • booking confirmations;
  • reminders and notifications;
  • payment collection for workshops

Unless expressly stated otherwise, the Artist or organizer remains solely responsible for conducting the Creative Experience.

10.3 Participant Responsibilities

Participants agree to:

  • arrive on time where attendance is required;
  • behave respectfully towards instructors and fellow participants;
  • follow all reasonable safety instructions;
  • use tools, equipment and materials responsibly;
  • comply with venue rules and applicable laws.

Artists may refuse participation or remove attendees whose conduct poses a risk to others or materially disrupts the Creative Experience.

10.4 Health & Safety

Some Creative Experiences involve the use of tools, machinery, chemicals, heat, sharp instruments or other materials that may involve inherent risks.

Participants acknowledge that they voluntarily participate in such activities and are responsible for assessing whether the activity is suitable for them.

Artists are responsible for conducting their Creative Experiences in a reasonably safe manner and complying with applicable health and safety requirements.

10.5 Changes & Cancellations

Artists may occasionally need to:

  • reschedule a Creative Experience;
  • change the venue;
  • substitute an instructor;
  • modify workshop content; or
  • cancel the event.

Artists are responsible for notifying registered participants of such changes as soon as reasonably practicable.

Where feasible, Hobbymela may assist by sending notifications through the Platform but is not responsible for ensuring that such communications are received.

11. Community Features

Hobbymela encourages respectful collaboration, learning and creative exchange.

The Platform may include Community Features such as:

  • comments;
  • reviews;
  • reactions;
  • discussions;
  • Artist follows;
  • messaging (if introduced);
  • groups or forums (if introduced);
  • event discussions;
  • creative showcases; and
  • other interactive features.

Community Features are intended to foster a positive and inclusive environment for all Users.

12. Community Standards

When using the Platform, you agree to interact with others respectfully and responsibly.

You must not:

  • harass, threaten or intimidate other Users;
  • post content that is hateful, discriminatory or abusive;
  • impersonate another individual or organization;
  • deliberately spread false or misleading information;
  • spam or send unsolicited commercial communications;
  • manipulate engagement through automated means;
  • encourage or facilitate unlawful activity;
  • interfere with another person's use of the Platform.

HobbyMela may remove content or restrict access where it reasonably believes these standards have been violated.

13. User Content

The Platform allows Users and Artists to publish User Content, including:

  • profile information;
  • portfolios;
  • product listings;
  • workshop details;
  • photographs;
  • videos;
  • artwork;
  • reviews;
  • comments;
  • discussions; and
  • other creative or informational material.

You remain the owner of the User Content that you create and publish.

13.1 License to HobbyMela

By submitting User Content to the Platform, you grant HobbyMela a non-exclusive, worldwide, royalty-free, revocable license to:

  • host;
  • store;
  • display;
  • reproduce;
  • distribute;
  • adapt (for formatting purposes only);
  • promote; and
  • communicate your User Content,

solely for the purpose of operating, maintaining, improving and promoting the Platform.

This license does not transfer ownership of your User Content to HobbyMela.

The license ends when you permanently remove the relevant User Content from the Platform, except where:

  • HobbyMela is legally required to retain copies;
  • the content forms part of system backups;
  • the content has already been shared or relied upon by other Users in accordance with the Platform's functionality.

13.2 Your Responsibilities

You represent and warrant that:

  • you own or have the necessary rights to publish your User Content;
  • your User Content does not infringe the intellectual property or other rights of any person;
  • your User Content complies with applicable laws;
  • your User Content does not contain malware or harmful code.

You remain solely responsible for the User Content you publish.

14. Intellectual Property

Unless otherwise indicated, the Platform, including its software, branding, logos, graphics, layout, text, databases and original editorial content created by Hobbymela, is owned by or licensed to Hobbymela and is protected by applicable intellectual property laws.

Nothing in these Terms transfers ownership of HobbyMela's intellectual property to any User or Artist.

14.1 Artist Intellectual Property

Artists retain ownership of their:

  • artwork;
  • designs;
  • photographs;
  • videos;
  • workshop curriculum;
  • product designs;
  • portfolios;
  • trademarks;
  • logos; and
  • other original creative works.

Except for the limited license granted under these Terms, HobbyMela does not claim ownership of an Artist's intellectual property.

14.2 Promotional Use

To help promote the creative community, Artists authorize HobbyMela to feature publicly available content from their Artist Profiles in:

  • search results;
  • featured artist sections;
  • newsletters;
  • social media;
  • editorial content;
  • promotional campaigns; and
  • other Platform communications.

HobbyMela will not sell or commercially license an Artist's original creative work to third parties without the Artist's separate permission, unless required to provide the Platform or otherwise agreed.

15. AI-Generated & Digitally Assisted Content

HobbyMela welcomes innovation while encouraging transparency.

If an Artist uses artificial intelligence or other digital tools to create or substantially modify creative work, the Artist should accurately represent the nature of that work where such information would reasonably influence a User's purchasing or participation decision.

Artists must not misrepresent AI-generated or mass-produced content as entirely handmade where doing so would be misleading.

HobbyMela may introduce additional guidelines relating to AI-generated content from time to time.

16. Reviews & Ratings

Users may submit reviews and ratings based on their genuine experiences with Artists, workshops or other Platform services.

Reviews should be:

  • truthful;
  • respectful;
  • relevant;
  • based on actual experiences.

Users must not:

  • submit false or misleading reviews;
  • offer or accept incentives in exchange for undisclosed reviews;
  • manipulate ratings;
  • post reviews on behalf of another person.

HobbyMela reserves the right to moderate or remove reviews that violate these Terms or applicable laws.

The opinions expressed in reviews are those of the individual Users and do not necessarily reflect the views of HobbyMela.

17. Acceptable Use of the Platform

HobbyMela is intended to be a trusted platform for creativity, learning and collaboration. You agree to use the Platform responsibly and only for lawful purposes.

You must not:

  • violate any applicable law or regulation;
  • use the Platform for fraudulent, deceptive or misleading activities;
  • interfere with the security or proper functioning of the Platform;
  • attempt to gain unauthorized access to any account, database or system;
  • introduce viruses, malware or other harmful software;
  • scrape, harvest or extract data from the Platform without HobbyMela's prior written consent;
  • use bots or automated tools to create accounts, post content or manipulate engagement, except where expressly permitted;
  • misuse Community Features to harass, spam or intimidate others;
  • upload or distribute content that infringes another person's intellectual property or privacy rights;
  • use the Platform in a way that disrupts or negatively impacts other Users.

HobbyMela may investigate suspected misuse and take appropriate action, including restricting or terminating access to the Platform.

18. Prohibited Content

The following types of content are not permitted on the Platform:

  • unlawful or illegal material;
  • counterfeit or stolen goods;
  • plagiarized artwork or content;
  • content that infringes copyrights, trademarks or other intellectual property rights;
  • false or misleading product descriptions;
  • fake reviews or testimonials;
  • impersonation of another individual or organization;
  • spam or unsolicited promotional content;
  • content containing malware or malicious code;
  • material that is hateful, discriminatory, threatening or abusive;
  • content that promotes violence or unlawful conduct.

Artists must accurately represent the origin and nature of their work. Handmade, handcrafted or original works should not be misrepresented, and products that are mass-produced, imported or substantially AI-generated must not be presented in a manner that is likely to mislead Users.

19. Privacy & Personal Information

HobbyMela values your privacy and is committed to protecting your personal information.

Our collection, use, storage, sharing and protection of personal information are governed by our Privacy Policy, which forms part of these Terms.

By using the Platform, you acknowledge that HobbyMela may process your personal information in accordance with the Privacy Policy and applicable law.

You are responsible for ensuring that the information you provide is accurate and up to date.

19.1 Artist–User Communications

HobbyMela facilitates communication between Users and Artists through enquiry forms and Platform communication features. To operate and support these features, Hobbymela may access, process and retain information contained in such enquiries and communications for purposes including facilitating and monitoring responses, following up on unanswered enquiries, providing assistance to Users, addressing complaints or disputes, maintaining Platform safety and service quality, preventing misuse or fraud, enforcing HobbyMela’s policies, and complying with applicable law.

Hobbymela will process such information only for the purposes described in its Privacy Policy and in accordance with applicable data protection laws.

20. Electronic Communications

By creating an Account or using the Platform, you consent to receive electronic communications from HobbyMela.

These may include:

  • account verification;
  • password resets;
  • booking confirmations;
  • workshop reminders;
  • security notifications;
  • policy updates;
  • customer support communications;
  • newsletters and marketing communications where you have chosen to receive them.

You may opt out of promotional communications at any time using the unsubscribe mechanism provided. However, operational and security-related communications are essential for the use of the Platform and cannot be opted out of while your Account remains active.

21. Third-Party Services

The Platform may include links to or integrations with third-party services such as payment providers, social media platforms, mapping services, video conferencing tools or courier services.

These services operate independently of HobbyMela and are governed by their own terms and privacy policies.

HobbyMela is not responsible for the availability, accuracy, security or practices of third-party services and does not endorse or guarantee their products or services unless expressly stated.

Your interactions with third-party services are solely between you and the relevant provider.

22. Platform Availability

HobbyMela continually works to maintain a reliable and secure Platform. However, we do not guarantee that the Platform will always be:

  • available;
  • uninterrupted;
  • error-free;
  • secure; or
  • compatible with every device or browser.

The Platform may be temporarily unavailable due to maintenance, technical issues, internet outages, cyber security incidents, system upgrades or events beyond our reasonable control.

HobbyMela may modify, suspend or discontinue any part of the Platform where reasonably necessary to improve services, maintain security or comply with legal obligations.

23. HobbyMela's Role & Disclaimer

HobbyMela is a facilitator of connections within the creative ecosystem.

Unless expressly stated otherwise, Hobbymela:

  • is not the seller of products listed by Artists;
  • is not a party to contracts for the sale of products between Users and Artists;
  • does not guarantee the quality, authenticity, safety or suitability of products or services offered by Artists;
  • does not employ Artists or act as their representative;
  • does not supervise or control the conduct of Users or Artists outside the Platform.

HobbyMela may verify certain information, feature selected Artists or moderate content, but such actions do not constitute an endorsement or guarantee of any User, Artist, product or service.

Users are encouraged to exercise their own judgement before entering into transactions or participating in Creative Experiences.

24. Disclaimer of Warranties

To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis.

HobbyMela does not warrant that:

  • the Platform will always operate without interruption or error;
  • all information provided by Users or Artists will be complete or accurate;
  • products or services offered by Artists will meet your expectations;
  • Creative Experiences will achieve any particular learning or artistic outcome;
  • Community Features will always be available or free from misuse by other Users.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

25. Limitation of Liability

To the maximum extent permitted by law, HobbyMela, its Founder, employees, affiliates and representatives shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to:

  • your use of or inability to use the Platform;
  • User-generated Content;
  • interactions between Users and Artists;
  • product purchases made directly from Artists;
  • participation in Creative Experiences;
  • technical failures, interruptions or security incidents;
  • loss of profits, revenue, goodwill, business opportunities or data.

Where HobbyMela is found liable despite the limitations set out above, its aggregate liability for any claim arising from your use of the Platform shall not exceed the amount paid directly by you to HobbyMela for the specific service giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the claim.

If no payment has been made directly to HobbyMela, HobbyMela's liability shall be limited to the extent permitted by applicable law.

Nothing in these Terms limits liability for fraud, willful misconduct or any liability that cannot legally be excluded.

26. Indemnity

You agree to indemnify, defend and hold harmless HobbyMela, its founder, employees, affiliates and representatives from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from:

  • your breach of these Terms;
  • your misuse of the Platform;
  • your violation of applicable law;
  • your infringement of another person's intellectual property or other rights;
  • Content that you publish;
  • products, services or Creative Experiences that you offer as an Artist; or
  • your negligent, fraudulent or unlawful conduct.

This obligation survives the suspension or termination of your Account.

27. Suspension & Termination

HobbyMela may suspend, restrict or terminate your Account, temporarily or permanently, if we reasonably believe that you have:

  • breached these Terms;
  • violated applicable laws;
  • engaged in fraudulent or deceptive conduct;
  • repeatedly received legitimate complaints;
  • uploaded prohibited Content;
  • compromised the security or integrity of the Platform; or
  • acted in a manner that poses a risk

28. Reporting Content & Policy Violations

HobbyMela is committed to maintaining a safe, respectful and trustworthy creative community.

If you believe that any Content, Artist Profile, product listing, workshop, review or activity on the Platform:

  • violates these Terms;
  • infringes your intellectual property rights;
  • is fraudulent or misleading;
  • is unlawful;
  • threatens the safety of Users; or
  • otherwise undermines the integrity of the Platform,

you may report the matter through the reporting tools available on the Platform or by contacting HobbyMela Support.

Hobbymela may request additional information to investigate a report and may remove, restrict or retain Content based on its assessment, applicable law and these Terms.

Submitting a report does not guarantee that Content will be removed or that a particular outcome will be reached.

29. Grievance Redressal

HobbyMela is committed to addressing genuine concerns fairly, transparently and in a timely manner.

HobbyMela will endeavour to acknowledge complaints within a reasonable period and resolve them as efficiently as possible. Resolution timelines may vary depending on the nature and complexity of the matter.

30. Changes to the Platform

HobbyMela continuously evolves its services to improve the user experience and support the creative ecosystem.

Accordingly, HobbyMela may:

  • introduce new products, services or features;
  • modify existing functionality;
  • discontinue services;
  • launch premium offerings or subscriptions;
  • integrate payment, logistics or verification services;
  • introduce new Community Features; or
  • make technical or operational improvements.

Where a change materially affects your rights or obligations, HobbyMela will provide reasonable notice where required by applicable law.

31. Changes to these Terms

HobbyMela may update these Terms from time to time to reflect changes in:

  • applicable laws and regulations;
  • Platform functionality;
  • business operations;
  • technology;
  • security requirements; or
  • industry best practices.

The revised Terms will be published on the Platform together with the updated "Last Updated" date.

Your continued use of the Platform after the revised Terms become effective constitutes your acceptance of the updated Terms.

If you do not agree with the revised Terms, you should discontinue using the Platform.

32. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

Nothing in these Terms limits any rights or remedies available under mandatory provisions of applicable law, including consumer protection and data protection laws.

33. Dispute Resolution

Hobbymela believes that most disputes can be resolved through constructive dialogue.

Before commencing formal legal proceedings, the parties agree to make reasonable efforts to resolve disputes amicably by communicating with each other in good faith.

If a dispute cannot be resolved within thirty (30) days of written notice from one party to the other, the parties may mutually agree to refer the matter to mediation.

If mediation is unsuccessful or is not pursued, the dispute shall be finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time.

Unless otherwise agreed:

  • the arbitration shall be conducted by a sole arbitrator appointed by mutual agreement of the parties;
  • the seat and venue of arbitration shall be Mumbai, Maharashtra, India;
  • the proceedings shall be conducted in the English language.

Nothing in this clause prevents either party from seeking interim or injunctive relief from a court of competent jurisdiction where necessary.

34. Force Majeure

HobbyMela shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from events beyond its reasonable control, including:

  • natural disasters;
  • floods;
  • earthquakes;
  • pandemics or epidemics;
  • government actions or restrictions;
  • strikes or labour disputes;
  • internet or telecommunications failures;
  • cyber-attacks;
  • widespread power outages; or
  • any other force majeure event.

Hobbymela will make reasonable efforts to resume normal operations as soon as practicable.

35. Assignment

You may not assign, transfer or delegate your rights or obligations under these Terms without HobbyMela's prior written consent.

HobbyMela may assign or transfer its rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of assets or other lawful business transaction, provided that such transfer does not materially reduce your rights under these Terms.

36. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court or competent authority, that provision shall be interpreted to the maximum extent permitted by law to reflect its original intent, and the remaining provisions shall continue in full force and effect.

37. Waiver

Failure by HobbyMela to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other rights.

Any waiver shall be effective only if made expressly in writing by an authorized representative of HobbyMela.

38. Entire Agreement

These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and Hobbymela regarding your access to and use of the Platform.

These documents include:

  • Privacy Policy;
  • Artist Partner Terms;
  • Refund & Cancellation Policy;
  • Community & Content Policy; and
  • any additional policies or guidelines published by HobbyMela from time to time.

If there is any inconsistency between these Terms and a policy that specifically governs a particular service, the more specific policy shall prevail to the extent of that inconsistency.

39. Contact Us
